1. Who we are

The FIRST ACT Pulse service is provided by André Filipe Marques Moreira, sole trader ("we", "us"). By using the service you are contracting with André Filipe Marques Moreira. Contact: info@andremarquesmoreira.com.

2. Acceptance

By accessing or continuing to use the service you agree to these terms. If you use it on behalf of an organisation you confirm you have authority to bind it; if as an individual, that you are of legal age.

3. The service

FIRST ACT Pulse is a box-office analytics app that imports sales and reservation exports, compares snapshots and shows explainable alerts. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan.

4. Account

You must provide accurate information, keep your credentials confidential, and you are responsible for activity under your account.

5. Misuse

You must not use the service unlawfully, for fraud or spam, infringe intellectual property, introduce malware, probe for vulnerabilities, scrape, circumvent technical limits, reverse engineer or resell the service. You must not import end-customer personal data (names, emails or card details).

6. Analytics and AI

Metrics and suggestions, including AI-generated ones, support human judgement, may be inaccurate and are not forecasts or professional advice. You are responsible for verifying outputs and for the data you input, which you must have the right to use. We may refuse, filter or remove content and suspend accounts that breach these terms. Rights holders may report infringement to info@andremarquesmoreira.com; repeated infringement leads to suspension.

7. Intellectual property

We retain ownership of the service and its intellectual property, including software, documentation and branding. Your data remains yours; you grant us a limited licence to host and process it solely to provide the service.

8. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, renewal, cancellation and refunds are governed by Paddle's Buyer Terms (https://www.paddle.com/legal/checkout-buyer-terms). Subscriptions are monthly and renew automatically until cancelled; after cancellation, access continues until the end of the paid period.

9. Service level and warranties

We do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose.

10. Liability

Our total liability is capped at fees paid in the prior 12 months. We are not liable for indirect or consequential damages such as loss of profits, data or goodwill. Nothing limits liability for fraud, death or personal injury where law prohibits it. You will indemnify us for claims arising from your data, unlawful use or breach of these terms.

11. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. After termination you may request an export of your data within 30 days, after which it is deleted.

12. General

These terms are governed by Portuguese law and the courts of Lisbon have jurisdiction, without prejudice to mandatory consumer rights. You may not assign this agreement without consent; we may assign it in a merger or acquisition. Neither party is liable for delays caused by force majeure.
